Dymmock's Case

case 5. dymmock's case. In the Court of Wards. If a bargainee die after the execution of the indenture, yet if it be enrolled within the six months, the estate shall descend to his heirs. Upon an office after the death of Sir Henry Dymmock, for the manor of Pye in Ordington in the county of Warwick, it was thereby found, that the said manor, by indenture the 13th July, 13 Jac. 1. was bargained and sold to Sir Henry Dymmock and his [409] heirs for three thousand pounds; that upon the 4th October, 13 Jac. 1. ha died, and that upon the 30th October, 13 Jac. 1. this deed was enrolled ; and that his cousin and heir, who was married to Sir Walter Earl, was of the full ago of twenty-one years at the time of his death ; and that the manor is held by service of knighthood in capite. The question was, whether his heir shall sue livery, or shall be in quasi by descent, and not merely by descent, and in nature of a purchaser1 in whom the land is first vested 1 And it was referred to the two Judges assistants to the Court. Being moved before Montague, Chief Justice, Hobart, Chief Justice of the Common Pleaa, and Tanfield, Chief Baron, they held, that he should be in by descent, and should sue livery; for when the enrolment comes, and there is no act in the interim done to stop it, the estate vested in the ancestor ub initio by the uses limited : for the statute 27 Hen. 8. c. 16. being, "that nothing shall pass, &c. excepting by deed enrolled, &c." when the exception is performed, it is in the ancestor by the Statute of Uses ; and therefore the heir being within age shall be in ward, and being of full age shall sue livery. And it is not like to Billingham's case, that a bargainee, before enrolment, bargains and sells to another, and afterward the first deed is enrolled, and after that the second deed was enrolled also, yet nothing passed ; for he had not any estate in him at the time of the bargain to give to a stranger. So in Shelley's case, the heir was in quasi by descent, yet he waa not in ward, because the 350 MICHAELMAS TEEM, 14 JAC. 1. IN C. W. AND B. B. CKO. JAC. 410. use never vested in the ancestor.
