Electiorie firinte fuit port en Bank le Boy per Wolfe vers Henry Shelley de terres en Sussex sur lease fait per Eichard Shelley : & sur non culp', le Jury trove un special v'dict come ensuist (viz.) que Edward Shelley & Joan sa feme fuer aeisies en special taile refii en fee al Edward, & avoient issue Henry & Eichard ; Joan devie, Henry devie en vie de Edward, ajant issue Mary sa file ore en pleine vie, & relinquishant son feme inseint ove Henry ore le defendant: & que Edward per Indenture, dated 25. Septembris anuis 1 & 2 Phil. & Mar. ac primo deliberat' 6. Octobris eodeni anno, covenant ove Martin & Cowper de suffer un common recov'y al use de luy in pur vie sans impeachmt cle wast, & puis son decease al use de Carel & auters pur 24. ana, & puis lease 24. ans expires, al use des heires males del corps le dit Edward, & des heires males des corps de tiels issues males, [137] & pur default de tiel issue, al use des heires males del corps, John Shelly de Michelgrove, & ouster que le 9. jour de Octob. Us auxi trove le terre en lease pur ans al temps del recov'y per demise fait devant le testa del original, & que Eichard Shelley le puisne fits de Edward enter, & fait le lease al Woolfe ore pi', & q Henry Shelley fits de Henry, eigsne fits de Edward, enter sur luy, & luy eject, &c. Et si, &c. Le case fuit argue sovent foits al barre. Termino Hill. & Anno 24 Eliz. per Fenner, Francis Gawdy & Anderson Sergeants ove le pi', & per Cook utter-barrester, Cowper Apptice & Popham Solicitor la Eoigne ove le def. Et fuit divide en 4. points : le primer, si le recovery suffer per Edward Shelley le jour que il morust soit bone. Le 2. Si le recov'y suffer per luy esteant tenant en taile, poit estre execute puis son decease sur le issue. Le 3. si ascii use surda sur le recovery devant execucon de ceo. Le 4. si Eichard Shelley le second fits devant le nestre de Henry 1'enfant prist le terre per purchase ou per discent. Le Councel del pi' argue pur le primier point, que le recov'y fuit bone, car est un act de record que ne poit admitter ascii division en un jour, mes est destre dit fait le primer instant del jour ; & sic suppose en ley desire fait en vie de Edward Shelley.
