FOREWORD
Much has been written about great judges and about the business of judging. But considering how important the process is, remarkably little has been said about the nuts and bolts of reading, writing and analysing judgments.
Andrew Goodman, as his acknowledgements and bibliography attest, has researched the subject widely, and his inspiration, evident from the number of references to it, is clearly Adler and Van Doren, How to Read a Book. But who are the readers of judgments?
Judges’ decisions are, for the most part, only of interest to the parties and to their lawyers. The general public will rarely read a judgment, although they may read an account of a decision in the media. The Supreme Court has taken to publishing summaries of its decisions to encourage wider readership, and of course judgments are almost always given in what is known as ‘open court’. But unless there is a story of public interest (in the non-technical sense)...
