The Legal Advice and Assistance (Scotland) (Financial Conditions) Regulations 1984

In exercise of the powers conferred on me by section 15 of the Legal Aid (Scotland) Act 1967(a) and sections 1 and 11 of the Legal Advice and Assistance Act 1972(b), and of all other powers enabling me in that behalf, I hereby make the following regulations:—

1.—(1) These regulations may be cited as the Legal Advice and Assistance (Scotland) (Financial Conditions) Regulations 1984 and shall come into operation on 26th November 1984.

(2) In these regulations, "the Act" means the Legal Advice and Assistance Act 1972.

2. For the purposes of section 1(a) of the Act, there is hereby prescribed the weekly sum of £108 in place of the weekly sum of £103 prescribed by the Legal Advice and Assistance (Scotland) (Financial Conditions) (No. 3) Regulations 1983(c).

3. For the purposes of section 1 of the Act, there is hereby prescribed the capital sum of £765 in place of the capital sum of £730 prescribed by the Legal Advice and Assistance (Scotland) (Financial Conditions) (No. 3) Regulations 1983.

(b) 1972 c. 50; section 1 was amended by the Legal Aid Act 1979 (c. 26), section 13(1) and Schedule 1, paragraph 5; section 11(1) was amended by the said Act of 1979, section 13(1) and Schedule 1, paragraph 7.

4. The Legal Advice and Assistance (Scotland) (Financial Conditions) (No. 3) Regulations 1983 are hereby revoked.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These regulations increase the disposable income limit for eligibility for legal advice and assistance under the Legal Advice and Assistance Act 1972 from £103 a week to £108 a week and increase the disposable capital limit from £730 to £765.
