The Lord Chancellor, in exercise of the powers conferred on him by sections 3 and 20 of the Legal Aid Act 1974(a), hereby makes the following Regulations:—

1. These Regulations may be cited as the Legal Advice and Assistance (Prospective Cost) Regulations 1985 and shall come into operation on 1st January 1986.

2. The limit applicable under section 3(2) of the Legal Aid Act 1974 where advice and assistance is to be given to persons arrested and held in custody in connection with an arrestable offence, as defined in section 24 of the Police and Criminal Evidence Act 1984(b), shall be £90.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations prescribe a limit of £90 on the cost of legal advice and assistance under sections 1 and 2 of the Legal Aid Act 1974 which a solicitor may incur without obtaining the approval of the appropriate authority where advice and assistance is to be given to persons arrested and detained in connection with an arrestable offence.
