Lagos Local
Government
(Amendment) Ordinance 1959
(No. 18 of1959)
THIS
amends
the
Lagos Local
Government
Law, 1953, originally
enacted
by
the Western Region.
In
view
of
the
extensive
amendments
to
the
legislation
since effected, provision is
made
for
the
reprinting
and
re-designation
of
the
principal
law
as
the
Lagos Local
Government
Ordnance,
1959.
The
principal
objects
of
the
amendments
are
to assimilate, in some degree,
the
prodecure
for elections to
the
Lagos
Town
Council to
the
procedure
for
Federal
elections,
and
to
carry
into
effect
the
bulk
of
the
steps proposed by
Sir
John
Imrie! to
improve
the
local
government
of
the
town.
The
residential qualification
of
voters
"shall
be
determined
by reference
to
the
tests
applied
for
the
purpose
of
an
election to
the
House
of
Representa-
tives"
and
the
Federal
Register
of
Voters will be used for
Town
Council
purposes.
Provision exists for some control to be exercised by
the
Federal
Government
in
the
event
of
there
being a
breakdown
in local
government
administration,
causing a
danger
to
health,
safety or welfare of
the
public.
The
Ordinance
also
provides for
the
effective use
of
financial
grants
to be
made
on a
percentage
basis in accordance
with
the
Imrie
Report,
for
the
establishment
ofa
Municipal
Service Commission to advise
the
Council on matters relating to
appointments,
and
to
make
provision for
the
establishment
of
a
Municipal
Transport
Board.
The
Town
Council has recently
acquired
the
major
passenger bus service.
The
extent
of
remuneration
of
the
President
of
the
Lagos
Town
Council
is specified
and
provision is
made
for
the
remuneration
of
the
Chairman,
although
none is received by
him
at
present. A
measure
of
protection
is
provided
for local
government
officers in
the
form
of
an
appeal
in cases
of
dismissal for
inefficiency.

status
and
duties of
the
principal
officers
of
the
Lagos
Town
Council
are
provided for in
greater
detail.

THIS
measure
introduces several
radical
but
unrelated
changes,
the
most
important
of
which
are
given below.
The
Minister after a
public
enquiry
and
after consultation
with
the
Muncipal
Council or Board,
may
establish aParish Council
within
the
area
of
a
munici-
pality.
This
is in line
with
a
recommendation
of
the
East
Africa
Royal
Commis-
sion.

The
Constitution
and
procedure
of
the
Parish Council
are
to be defined by
the
Minister
and
the
council will exercise
powers delegated to it by
the
Muncipal
Councilor
Board or conferred on it
by
the
Minister.
