A African District Councils
(Amendment)
Ordinance

THISmeasure introduces
many
amendments
to
the
principal
ordinance
of
19501 ;
it increases
the
powers
of
African District Councils, makes
the
supervision of
them
by
the
Central
Government
more
effective,
and
brings
the
ordinance
more
into
line
with
other
local
government
legislation in
Kenya.
It
is now
laid
down
that
councils
must
notify district commissioners
of
the
date
and
proposed business
of
each
council meeting, so
that
they
or
their
staff
may
exercise
their
right
to
attend
and
speak at such meetings
(but
not
to vote,
unless
of
course
they
are
council members).
Chairmen
of
councils
if
appointed
by
provincial commissioners
are
to
hold
office for
any
period up to
three
years,
but
if elected
they
are
to hold office for one
year
at
atime, in
either
case office
being
conditional on
continuing
membership
of
the
council.
In
the
case
of
committees consisting
of
council
members
and
central
govern-
ment
representatives,
there
was a proviso
that
the
latter
were
debarred
from
voting
on questions
other
than
those concerning a
report
or recommendation.
Since these committees
are
often administering schemes
partly
financed by
central
government
monies, it has
been
thought
right
to delete this proviso,
but
it is now laid
down
that
members
of
the
appointing
council shall always be
in the
majority
on such committees in future.
Other
amending
clauses
empower
district councils to
promote
schemes for
the supply of electricity (including
power
to
purchase
land)
and
clarify
the
provisions for the
auditing
of
accounts.
The
powers
of
auditors
are
also clarified.
African locational councils
may
now be
authorized
by the provincial com-
missioner to
have
aspecified
number
of elected members in
addition
to those
appointed:
provision is also
made
for these councils to
submit
annual
estimates
via
the
district councils to the Commissioner for Local Government.
TANGANYIKA
Arusha Town Council
(Special Provisions)
Ordinance No. 47
of
1957
THIS
ordinance
gives
the
Arusha
Town
Council powers to
buy
land
outside the
boundaries
of
the
township to allow for future development,
and,
till such
land
is sold, to
continue
cultivating it,
and
selling the
produce
grown.
The
preliminary
stages of this scheme were in fact
taken
before the
ordinance
was passed,
and
it
therefore validifies
such
action.
The
purchase
price
of
the
land
was borrowed
from local banks (against a
government
guarantee
of
repayment)
and
the
intention
is to
repay
the loans from
the
proceeds
of
the
sale
of
sisal
and
coffee
grown
and
then
to
make
the
land
available for development.
