mayow's case. Gulielme Trumplin, possesse de divers biens morust intestate, efc apres I'administra-tion fuit commit al Mayow, q, fuit uncle al intestate (viz.) frere sa mere, apres Thomas Trumplin, labour pur revocation de c administration en le Arches, et sur sentence le administration fuit confirme, et apres il appeal a Eoy en le Chancery, que apres appoynt Commissioners Delegates, et la le cause q^ Serjeant Ashley, done pur aver un prohibition fuit. Si Ordinary comit 1'administration al un q^ nest de kinne al intestate un prohibition "voet estre grant, come si apres le statute 31 E. 3. ^ ordeyne, q^ administration soit commit al loyal amyes del iu-[68]-testate, si 1'Ordinary grant l'administration a tiel, que ne issint sont, come persons utlagat ou attaint, queux tie sont legales, un prohibition gist, ou auterment serroit sans remedy. L'statute de 31 H. 8. ne differt de c statute, mes solment, q^ un pain est ad (viz.) 101. En Le Duke de Suffolk's case, 5 E. 6. administration poet esbre grant al un de demy sank, & si un de entier sank vint, poet aver un prohibition. M. 21 Jac. un prohibition fuit grant sur 1'estat, 21 H. 8. sur privity de sank, & c depend sur un demurrer, & les parties compound. Noy e contra. Mayow fuit charge devant les Delegates, que il administ falsly, & ad suppress un volunt, & en c case 1'Ordinary est un competent Judge. Et 21 H. 8. n'ad tol le conusance del case de la Ecclesiastical Judge; & 1'statute ne dit, q, Tadministration serra grant al prochein de sank, ou auterment I'administration serra void, mes q^ I'administratiou serra grant de south pain.
