The National Health Service (Constitution of Health Boards) (Scotland) Amendment Order 2003

Made 25th March 2003

Coming into force 1st April 2003

The Scottish Ministers, in exercise of the powers conferred by section 2(1) of the National Health Service (Scotland) Act 19781, and of all other powers enabling them in that behalf, hereby make the following Order:

S-1 Citation and commencement

1. This Order may be cited as the National Health Service (Constitution of Health Boards) (Scotland) Amendment Order 2003 and shall come into force on 1st April 2003.

S-2 Amendment of the National Health Service (Constitution of Health Boards) (Scotland) Order 1974

Amendment of the National Health Service (Constitution of Health Boards) (Scotland) Order 1974

2.—(1) The National Health Service (Constitution of Health Boards) (Scotland) Order 19742is amended as follows.

(2) Omit article 5.

(3) For the Schedule, substitute the Schedule set out in the Schedule to these Regulations.

(This Note is not part of the Order)

This Order deletes article 5 of the National Health Service (Constitution of Health Boards) (Scotland) Order 1974 (“the 1974 Order”) which provided that each health board shall consist of a chairman and such numbers of other members, not more than a maximum number.

As a consequence of the deletion of article 5, the Schedule to the 1974 Order is replaced.


(1) 1978 c. 29. Section 2(1) was amended by the National Health Service and Community Care Act 1990 (c. 19), section 28(a)(i) and (ii) and (b). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
