Code of practice under Criminal Procedure and
Investigations Act
1996
The Home Secretary has laid before Parliament a Code of Practice issued
under
s.
23 of the Criminal Procedure and Investigations Act 1996
(Hansard,
18
December 1996). The Code will replace the draft Code previously issued
(discussed in
Blackstone's Guide to the Criminal Procedure and Investigations
Act
1996,
ch. 2) and is expected to be brought into force in March 1997.

Where a confession has been obtained from a vulnerable suspect in the
absence of an appropriate adult, in determining reliability and admissibility
under
s.
76(2)(b) of the Police and Criminal Evidence Act 1984 a court should
hear evidence of who was present and how the interview went, in order to
form an impression of the effect on the suspect of the absence of the
appropriate adult:

The Director

Public Prosecutions has announced a joint initiative between
the Crown Prosecution Service and the police to ensure that working
practices in relation to disclosure will comply with new obligations under the
Criminal Procedure and Investigations Act 1996: Speech to the British
