Ombudsman can't look into worried mum's school issue

The Ombudsman's report says the Local Government Act 1974 sets out its powers but also imposes restrictions on what they can investigate

Mrs X's daughter has a diagnosis of autism but does not have an Education Health and Care Plan (EHC Plan), although Mrs X has asked for an Education Health and Care

Needs Assessment (EHCNA). Mrs X complains her daughter did not receive appropriate support for her needs either before her diagnosis or since and formally complained to the council.

In its response, the council accepted that there had been issues with the way it had communicated and has set out a number of practical steps to take, but Mrs X is not satisfied with the response, which she says has not led to significant change in the support her daughter has received.

She further complains that the council has not yet responded to her request for an EHCNA.

But until a pupil with special educational needs has an EHC Plan in place, it falls to their school to provide any appropriate...
