In the  rst half of 2016 (the reporting period) the Court of Justice of the European
Union (EU) delivered various interesting rulings concerning the rights to social
(security) bene ts of Union citizens who exercise their free movement rights.  e
rulings touch upon a variety of issues, including (i) the right of Union citizens who
have only resided in another Member State for a short period of time to claim socia l
assistance (García-Nieto), (ii) the competence of Member States to make entitlement
to social security bene ts falling within the scope of Regulation 883/2004 on the
coordination of social securit y systems1 conditional upon lawful residence in t heir
territory (Commission v United Kingdom), (iii) Member States’ declarations on the
application of the coordination ru les to their social bene t systems (Commission
v Malta), (iv) the pri nciple of equal treatment of bene ts, income, facts or events
(Knauer), (v) the pension rig hts of civil servants who resign (Commission v Cyprus)
and (vi) the aggregation rule s for unemployment bene ts (M.).

ASSISTANCE: GARCÍANIETO
García-Nieto is the latest in a series of recent ru lings in which the Court has moved
away from its classic ‘citizenship case law’.  a t c as e la w i mpl ie d, in bri ef , t hat (i) Uni on

law3 or international law4 were entitled to equal treatment regardles s of nationality as
