Preface

Welcome to the 7th edition of this guide to small claims cases in the County Court. The book has been completely updated. It is a fully professional text but easily usable by non-lawyers and those who are acting for themselves. Both authors have had many years’ experience as judges handling small claims cases and we have drawn upon our practical knowledge to help all users of the book.

The book contains all the material needed to take a case to a final hearing and beyond, with references to enable the reader to access online information. We have extended the Glossary, and the language used throughout is straightforward and non-technical. We have included extensive cross referencing and footnotes.

Earlier editions described the small claims track as having a ‘no costs rule’, but this is no longer accurate. Instead, we have adopted ‘limited costs’.

The financial ceiling for small claims remains £10,000. Claims for personal injuries create difficulties for litigants in person and the track has always excluded injury...
