THE VICE PRESIDENT: In this case the Court orders that the order of the House of Lords on 13th December 2001 be made an order of this Court and that the confiscation order made against David Cadman Smith on 2nd October 1998 at Sheffield Crown Court on a charge of fraudulent evasion of excise duty contrary to section 170(2) of the Customs & Excise Management Act 1979 is restored.
