It was difficult to conceive of a situation where both holding a trial in secret and withholding the names of the defendants could be justified.
The Court of Appeal, Criminal Division (Lord Justice Gross, Mr Justice Simon and Mr Justice Burnett) so stated in delivering a decision on June 12, 2014, allowing the appeal of Guardian News and Media Ltd against the order of Mr Justice Nicol made on May 19, 2014, which, inter alia, ordered: (1) th at the criminal trial of two defendants on terrorism charges would be held in private and publication of reports prohibited; (2) the names and identities of the defendants would be withheld and unpublished.
LORD JUSTICE GROSS said that it would frustrate the administration of justice in such an exceptional case to hold the trial in open court. The core of the trial had to be held in camera but certain limited parts could be conducted in open court. The...
