The Royal Navy Terms of Service (Ratings) (Amendment) Regulations 1986

The Defence Council, in exercise of the powers conferred upon them by section 2 of the Armed Forces Act 1966(a), and of all other powers enabling them in that behalf, hereby make the following regulations:

Citation and Commencement

1. These Regulations may be cited as the Royal Navy Terms of Service (Ratings) (Amendment) Regulations 1986 and shall come into operation on 1st January 1987.

Interpretation

2. In these Regulations "the Principal Regulations" means the Royal Navy Terms of Service (Ratings) Regulations 1982(b).

Amendments to the Principal Regulations

3. The Principal Regulations shall have effect as if for paragraph (3) of Regulation 3 there were substituted the following paragraphs:

"(3) In the case of a person who has attained the age of 16 years but has not attained the age of 19 years 7 months he may be entered under this paragraph for a special term of service in the Royal Navy which shall be a term:

(a) wholly of naval service;

(b) expiring either 12 months or 2 years from the date he first reports for duty following his entry into naval service, subject to the right of the person in question to determine his service at any time by 14 days notice in writing given by him to his commanding officer immediately before the date upon which it is to take effect;

(c) to which Regulations 4, 5, 7 and 8 shall not apply, but without prejudice to the application of those Regulations to any conversion of terms of service made under sub-paragraph (d) of this paragraph;

(a) 1966 c. 45; section 2(1)(f) was amended by the Armed Forces Act 1976 (c. 52), section 2.

(b) S.I. 1982/834; the relevant amending instruments are S.I. 1983/897, 1985/2003.

(d) in respect of which the person in question may give notice to his commanding officer of his desire to be treated as if he had entered naval service under a different term provided for by this Regulation, as may be specified in the notice; and if the authority specified in Schedule 1 of these Regulations as being the competent naval authority for the purpose of Regulation 8 approve, he shall be treated as if he had entered for such a term.

(4) Paragraph (5) below applies to a person:

(a) who entered after 31 March 1986 and before the Royal Navy Terms of Service (Ratings) (Amendment) Regulations 1986, come into operation for a term of 12 months...
