En trespass, le case fuit; A. seise en fee, covenant de levye un fine al use de luy mesme pur vie sans impeachment del wast, & ove power de grant, & done les arbors sur le terre, & power de faire leases, pur trois vies, ou 21 ans, le remainder al un John, son fits, sans impeachment del wast, & ove mesme power, ove divers remainders ouster. Accordant un fine fuit levye al uses avandits. Apres A. tenant pur vie fait un lease pur trois vies, exceptant les arbores crescont, ou de crescer en apres; le tenant pur vie (viz.) A. morust, si remaind cestuy en poet exercise son power (soil.) de scider, prender, & disposer les arbores durant c estate pur trois vies, c fuit le sole poynt en le case, p 1'opinion del Court; quia ils touts tient, que 1'exception des arbores fuit assets bien, per 1'exception, il poet prender les arbores a son pleasure al asoun temps durant son vie.
