4. Certificate or endorsement that a teacher qualified under the Regulations of 1931 or earlier regulations shall be deemed to hold under these regulations.

Whereas in accordance with the provisions of section 83(4) of the Education (Scotland) Act 1962(a) the Secretary of State intimated to the Scottish Joint Council for Teachers' Salaries, the Council constituted by him under the said section, his intention to make these Regulations under section 83(1) of the said Act.

And whereas, in accordance with the provisions of section 144(2) of the said Act, before making these Regulations, the Secretary of State caused a draft thereof to be published and sent a copy thereof to every education authority and has had regard to the representations made by them and by persons interested.

Now therefore in exercise of the powers conferred on him by sections 1(2),

(a) 10 & 11 Eliz. 2. c. 47.

75(3), 76(1), 81(2), 83(1) and 144(5) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Regulations:—

Citation and Commencement

1. These Regulations shall come into operation on 1st April 1965, and may be cited as the Teachers (Education, Training and Certification) (Scotland) Regulations 1965.

Interpretation

2.—(1) The Interpretation Act 1889(a) shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament.

(2) In these Regulations, unless the context otherwise requires—

(a) references to any enactment, regulation or rule shall be construed as references to the said enactment, regulation or rule as amended by any subsequent enactment, regulation or rule or to any enactment, regulation or rule substituted for that enactment, regulation or rule; and

(b) references to a Regulation or to a Schedule are references to a Regulation of these Regulations or to a Schedule to these Regulations as the case may be.

Definitions

3. In these Regulations, unless the context otherwise requires—

(1) "Board of Studies" has the same meaning as in the Regulations of 1958;

(2) "Certificate" means a Teacher's Certificate (Primary Education), a Teacher's Certificate (Secondary Education) or a Teacher's Certificate (Further Education);

(3) "Course" means a pre-service course or an in-service course;

(4) "Endorsement" means an endorsement made under Regulation 5;

(5) "Further education centre" has the same meaning as in the Further Education (Scotland) Regulations 1959(b);

(6) "Governing Body" has the same meaning as in the Regulations of 1958;

(7) "In-service course" means a course taken by a certificated teacher;

(8) "Pre-service course" means a course taken by a student leading to certification as a teacher;

(9) "Regulations of 1931" means the Regulations for the Preliminary Education, Training and Certification of Teachers for Various Grades of Schools (Scotland) 1931(c);

(10) "Regulations of 1958" means the Teachers (Training Authorities) (Scotland) Regulations 1958(d);

(11) "Scottish Council" has the same meaning as in the Regulations of 1958;

(12) "Teacher's Certificate (Primary Education)", "Teacher's Certificate (Secondary Education)" and "Teacher's Certificate (Further Education)" have the meanings given to them respectively in Regulation 4.

Types of certificate to be awarded

4.—(1) The Secretary of State may award the following certificates to persons who satisfy the relevant requirements under these Regulations—

(a) the Teacher's Certificate (Primary Education), being a certificate of competency to teach in primary schools or departments;

(b) the Teacher's Certificate (Secondary Education), being a certificate of competency to teach a subject or subjects in secondary schools or departments;

(c) the Teacher's Certificate (Further Education), being a certificate of competency to teach a subject or subjects in further education centres.

(2) A certificate shall state the date from which it is effective and a Teacher's Certificate (Secondary Education) and a Teacher's Certificate (Further Education) shall state the subject or subjects to which it relates.

(3) Where a person satisfies the requirements for the award of two or more certificates in final form the said certificates shall be set out in a single document, and for this purpose it shall be in the power of the Secretary of State to issue a new certificate in place of the certificate previously held by a certificated teacher.

Types of endorsement to be awarded

5.—(1) The Secretary of State may award to a certificated teacher who satisfies the relevant requirements under these regulations a special qualification to act as—

(a) a principal teacher of a nursery school, which qualification shall be awarded only to women; or

(b) an infant mistress, which qualification shall be awarded only to women; or

(c) a teacher of one or more categories of pupils requiring special educational treatment; or

(d) a teacher of backward pupils in secondary schools or departments; or

(e) a teacher in such other capacity as the Scottish Council, with the approval of the Secretary of State, may determine.

(2) The award of a special qualification shall be entered on the certificate by means of an endorsement, provided that such certificate shall not be so endorsed until the teacher has satisfied the probationary requirements in relation to the said qualification under Regulation 9.

(3) An endorsement shall state the date from which it is effective and in the case of an award under sub-paragraph (c) of paragraph (1) of this Regulation shall state the category or categories of pupils to which it relates.

Arrangements for courses leading to the award of a certificate or an endorsement

6. Pre-service and in-service courses of education and training leading to the award of certificates and endorsements shall be subject to and in accordance with the following conditions—

(1) the requirements for admission to a course leading to a certificate shall be as set out in Schedule 1;

(2) a candidate for admission to a course leading to an endorsement shall be a certificated teacher and shall satisfy the Governing Body as to his qualifications, training and, where appropriate, experience;

(3) a course shall be of such duration as the Scottish Council, with the approval of the Secretary of State, shall determine;

(4) the content of a course shall be determined by the principal of the college of education on the advice of the board of studies and with the approval of the Governing Body provided that where the course is to be provided partly in a central institution or a further education centre the content shall be so determined with the agreement of the Governing Body of the central institution or of the education authority or other Governing Body of the further education centre concerned;

(5) where a course is to lead to a diploma of a college of education which either of itself or with such supplementary qualifications as the Governing Body may require will constitute the principal qualification in terms both of education and training, for a Teacher's Certificate (Secondary Education) or a Teacher's Certificate (Further Education) it shall be for the Scottish Council, with the approval of the Secretary of State, to determine the subject or subjects in which such a course may be introduced by a Governing Body; and

(6) the nature and type of the examinations to be conducted during and at the end of a course shall be determined by the principal of the college of education with the advice of the Board of Studies and where part of the course is provided in a central institution or a further education centre, they shall be so determined in collaboration with the principal of the central institution or further education centre concerned:

Provided that, in the case of a candidate admitted under Regulation 8(2)(d), the duration and content of a course shall be such as the principal of the college of education may determine in the light of any guidance that may be given by the Scottish Council.

Rules and conditions for the award of a provisional certificate or a provisional endorsement

7. Each candidate who successfully completes a course under Regulation 6 shall be recommended to the Secretary of State by the Governing Body for the award of a provisional certificate or a provisional endorsement as the case may be, and the Secretary of State shall give effect to the recommendation.

Provided that where he is not a certificated teacher he shall have satisfied—

(1) the principal of the college of education that his conduct has been satisfactory and that he shows promise of success as a teacher, and

(2) the medical officer of the college of education that, in accordance with directions given by the Scottish Council under Regulation 38(2)(c) of the Regulations of 1958, he is medically fit to teach.
