[187] thursfield against jones, &o. Prohibition denied on a citation of the wardens of a company for a tax for the repair of a church charged upon their hall. 1 Nels. Abr. 444, pi. 9. Skinner 27. See 1 Mod. 79, 194, 236. 1 Salk. 165. A prohibition was prayed to the Consistory Court of London, for that there was a suit there against the Master and Wardens of the Company of for a tax imposed on the hall of the said company for the repair of the parish church, and it was said that the tax is not imposed on them in their natural capacity, but on the lands of the body politick. Per Curiam: A prohibition shall not issue, for the lands of the company are chargeable to the repairs, and the Spiritual Court (which has the cognizance of the matter) hath no other process than a citation, which cannot be executed on an aggregate corporation...
