Thusfeild and Jones, Master and Wardens of the Company of Waxchandlers

3. thusfeild and jones, Master and Wardens of the Company of Waxchandlers. Thusfeild and Jones, &c. were cited in the Spiritual Court, by the names of baptism and their sirnames, with the addition of Master and Wardens of the Company of Waxchandlers; and this was for not paying a rate set upon the hall for their company, for reparation of their parish church ; upon this they moved for a prohibition, and shewed for cause that they were cited by their sirnames and names of baptism, so sued in their natural capacity, when it should be in their politick capacity; but the Court said, there was no other way of citing them than this; they could not cite the body politick ; and therefore, unless by this way, they had no remedy: and 'twas not like a distringas at common law, by which they may take lands...
