The Tuberculosis (Compensation) (Scotland) Amendment Order 1977

In exercise of the powers conferred by sections 17(3), 19(7) and 85(1) of the Diseases of Animals Act 1950(a), and now vested in me(b), and of all other powers enabling me in that behalf, and with the approval of the Treasury, I hereby make the following order:—

Citation and commencement

1. This order, which may be cited as the Tuberculosis (Compensation) (Scotland) Amendment Order 1977, shall come into operation on 1st July 1977.

Interpretation

2.—(1) This order shall be construed as one with the Tuberculosis (Compensation) (Scotland) Order 1964(c), as amended(d), hereinafter referred to as "the principal order".

(2) The Interpretation Act 1889(e) applies for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

Amendment of the principal order

3.—(1) In Article 3(1) of the principal order (Interpretation) there shall be inserted in the definition of "the Act" after "1950" the words "as amended or extended by any subsequent enactment".

(2) Article 5(2) of the principal order (Compensation for "control animals") shall be amended—

(a) by the substitution for the words "any Order under the Act" of the words "an import licence issued under Article 3 of the Importation of Animals Order 1977(f)", and

(a) 1950 c. 36.

(b) By the Transfer of Functions (Animal Health) Order 1955 (S.I. 1955/958 (1955 I, p. 1184)).

(c) S.I. 1964/1152 (1964 II, p. 2643).

(d) S.I. 1972/825, 1976/259 (1972 II, p. 2656; 1976 I, p. 719).

(e) 1889 c. 63.

(f) S.I. 1977/944 (1977 II, p. 2631).

(b) by the substitution for the words "in an imported animals quarantine station" of the words "during quarantine".
