[5] arnold v. barrington. (Reg. Lib. fol. 864.) 24 Nov. 1631. Bond for performance of a promise to make a settlement having been cancelled by the obligor, he was ordered to settle lands agreeably to the bond. John Arnold, the plaintiff's brother, being seised of copyhold lands, and having issue two daughters, Elizabeth and Catherine, and intending to make a provision for Elizabeth, his eldest daughter, surrendered part of the lands to the use of the said Elizabeth, and other part thereof to Thomas Barrington for payment of his debts, and the residue being of the value of 500, he left unsurrendered to descend to Catherine his youngest daughter as heir by the custom of the manor : After the surrender, John Arnold made his will whereby he confirmed the surrender, and directed the * I searched the books but could not find any entry of it.-John Dickens. 168 SNELLING V. FLATMAN . DICKENS, 6. plaintiff to have the care of the marriage of his daughter, and appointed him executor. Afterwards, a clandestine marriage was effected between the defendant Walter Barrington, and the said Catherine; and, upon the marriage, the defendant Walter Barrington promised to make a jointure of lands of 60 a-year, and entered into a bond to the defendant Catherine in the penalty of 1000 for performance of the agreement.
