The Diseases of Animals (Approved Disinfectants) Order 1978

The Minister of Agriculture, Fisheries and Food, as respects England and Wales, and the Secretary of State, as respects Scotland, in exercise of the powers conferred by sections 1(1), 20(viii) and (ix) and 85(1) of the Diseases of Animals Act 1950(a), in so far as those powers are now vested in them severally(b), and the said Minister and the Secretary of State, acting jointly, in exercise of the powers conferred by sections 1(1), 11 (vi) and (vii), 20(viii) and (ix), 50(1) and 85(1) of the said Act of 1950, in so far as those powers are now vested in them jointly(c), and of all other powers enabling them in that behalf, hereby order as follows:—

Citation, extent and commencement

1. This order, which may be cited as the Diseases of Animals (Approved Disinfectants) Order 1978, shall apply to Great Britain and shall come into operation on 31st January 1978.

Interpretation

2.—(1) In this order, unless the context otherwise requires—

"the Act" means the Diseases of Animals Act 1950 as amended or extended by any other enactment;

"approved disinfectant" has the meaning assigned to that expression in Article 4;

"dilution rate" means the number of parts of water with which one part of an approved disinfectant is to be diluted;

"Foot-and-Mouth Disease Orders" means the Foot-and-Mouth Disease Order of 1928(d), as amended(e), and the Foot-and-Mouth Disease (Infected Areas Restrictions) Order of 1938(f), as amended(g);

"Fowl Pest Orders" means the Fowl Pest Order of 1936(h), as amended(i), and the Fowl Pest (Infected Areas Restrictions) Order 1956(j), as amended(k);

"general order" has the meaning assigned to that expression in Article 3(3);

"inspector" means a person appointed to be an inspector for the purposes of the Act by the Minister or a local authority and, when used in relation to an officer of the Minister, includes a veterinary inspector;

"the Minister" means the Minister of Agriculture, Fisheries and Food and the Secretary of State acting jointly;

"special disease order" means one of the orders mentioned in Article 3(1);

"Swine Vesicular Disease Order" means the Swine Vesicular Disease Order 1972(a), as amended(b);

"Tuberculosis Orders" means the Tuberculosis Order 1964(c), as amended(d), and the Tuberculosis (Scotland) Order 1964(e), as amended(f).

(2) Any reference in this order—

(a) to any order shall be construed as a reference to that order as from time to time amended or extended, and as including a reference to any order which may replace it, and

(b) to a numbered article or schedule is a reference to the article or schedule so numbered in this order.

(3) The Interpretation Act 1889(g) applies for the interpretation of this order as it applies for the interpretation of an Act of Parliament, and as if this order and the orders hereby revoked were Acts of Parliament.

Special disease and general orders

3.—(1) For the purposes of this order the Foot-and-Mouth Disease Orders, the Fowl Pest Orders, the Tuberculosis Orders and the Swine Vesicular Disease Order are special disease orders.

(2) Any reference in a special disease order to a disinfectant or an approved disinfectant shall be construed as a reference to any disinfectant for the time being listed as approved in Schedule 1 or Schedule 2 for use under that order.

(3) For the purposes of this order a general order is an order made under the Act by the Minister of Agriculture, Fisheries and Food or by the Secretary of State or by the said Minister and the Secretary of State acting jointly (other than this order or a special disease order), or regulations of a local authority made thereunder, in which there is a requirement for disinfection.

(4) Any reference in any general order to a disinfectant or an approved disinfectant shall be construed as a reference to a disinfectant for the time being listed in Schedule 1 or Schedule 2 as approved for use under general orders.

4. A disinfectant listed in column 1 of either Schedule 1 or Schedule 2 is an approved disinfectant.
