Midlothian couple take builder to court as they are 'ghosted over £5,000 bathroom'

The couple, who live with two small children, say they were left without running water after paying the company just under £5,000 for the work.

A court decree issued in December 2023 directs the firm to refund the Marshalls £4,799.00 - plus £110 expenses.

After being contacted by Edinburgh live, Mark Dudgeon, of Capital Wetwall Bathrooms, apologised for the situation and said they would process a full refund for the couple.

The Marshalls were first provided with a quote for the bathroom in March 2023 and after materials were delivered to their home, the sum of money was then transferred to the company.

The 45-year old mum said they were left with low shower pressure, cracks on the floor, a damaged shower tray seal and exposed wires.

The couple claim they have not had any contact from the company in around 10 months and are still waiting to be refunded for the work after complaining in June last year.

Tracy said: "It was on March 11, 2023, that Mark came out to us, and it was through a recommendation by somebody else who lives on the estate who had a successful bathroom fit. We did do a little bit of research and we went onto his Facebook page, had a look at some of the comments and photos that had been put up.

"We probably should have dug a bit deeper looking back on it now. He was very professional and was a typical salesman that you would expect - he had all the samples for us to look at and got us excited for it all. We confirmed an order with him and paid a deposit that day after he gave us a price which was just under £5,000.

"All the materials were delivered direct to our house a couple of weeks later. Upon delivery we transferred a further large amount of funds to Capital Wetwall Bathrooms Ltd. He explained to us initially that when the materials are delivered on-site, that's when we need to transfer the funds, apart from the fitter costs.

"Two fitters then arrived shortly after but they had no plans with them and had very little handover about the job. During the fitting process, there were many occasions where we had to correct what they were doing and it was very apparent their lack of experience. Not only that but the materials ordered were incorrect and several adjustments were made that week to accommodate the original plan.
