Assets of community value are a new invention. They were introduced as part of the Localism Act 2011 and have no counterpart at common law. At present, even though the provisions have been enacted in relation to both England and Wales, they have only been brought into force in England.

The impact of the provisions is not to be underestimated. They can have a significant impact on the landowner’s rights in relation to his land, both while the land is still in his ownership and also if the owner wishes to dispose of the land. The impact of the provisions has increased significantly since they were first introduced, as a result of changes to planning law in 2015. Proposals have been made to increase the scope of the provisions yet further.

The provisions have proved to be popular. The latest government figures available at the time of writing were that more than 3,000 buildings or other land had been listed as assets of community value (see Chapter 9). This figure looks set to increase significantly in the future.
