Notwithstanding anything contained
in
this Act the

The works authorised by the section of this Act whereof
the marginal note is

Power to construct works
shall
be constructed maintained and used only in accordance
with the following provisions
:-
(A)

part of the works shall be constructed
upon the highway known as Vastern Road or
so
as
in any way to reduce the width
of
that highway;
(B)
There shall be
a
clear headway throughout
from the surface of the road to the under surface
of the works of not less than twenty-five feet;
(c)
The height of the part of the bridge situate
over the highway from the under surface
to
the
top thereof shall not exceed eleven feet and the
width shall not exceed seven feet six inches;
(D)
The works shall be
so
constructed maintained
and
usecl that coal and other articles cannot fall
therefrom
on
to
any part of the highway;
(E)
No
advertisements shall be displayed upon any
part
of
the said works visible from the highway;
(F)
The bridge shall be
of
an ornamental design
reasonably approved by the corporation and the
whole of the said works
so
far
as
they are con-
structed across the highway shall be made and
maintained in accordance with plans sections and
specifications previously submitted to and reasonably
approved by the corporation
:
(2)
In thc exercise within the area
of
the borough
of
Reading for the time being of the powers
of
the
section of this Act whereof the marginal note is
“Power
to
break up streets not dedicated
to
public
use” no electric line main cable wire or apparatus
shall be laid down except in such situation and in
such
manner as may be reasonably approved by the
corporation

corporation touching this section or anything
to
be
done
or
not
to
be clone thereunder such clifference
shall be settled by an arbitrator to be agreed upon
or failing such agreement to be appointed by the
Board of Trade on the application
of
either of the
parties in difference and the Arbitration Act
1889
shall apply to the reference.

of the Electric Lighting Act
1885
Provided that
if
the council shall exercise the power given to
them by this section before the expiration
of
the said period
of
forty-two years they shall in addition to paying
to
the Conipany
the sum ascertained in accordance with the said section
pay
to
the Company such
a
further
sum as may be agreecl upon
or
determined by arbitration to be
the value
of
the gooclwill appertaining
to
the undertaking
of
the
Conipany in the aforesaid area calculated in respect
of
the period
from the date of purchase up
to
the date
of
the expiration
of
the aforesaid period of forty-two years.
(2)
For the purposes of but subject to the prorisions of
this section the provisions of section
2
of the Electric Lighting
Act
1888
shall with any necessary niodifications he deemed
to
apply to a sale
ancl
purchase under this section as
if
it were
a
sale and purchase ~mder that section.
(3)
No
pnrchase shall be effectetl under the prorisions
of
this section exccpt in pursuance
of
a
resolution passed at
a
special meeting of the coimcil and such special meeting shall
only be held after fourteen days’ previous notice
of
the
same
