West Lothian prisoner slashed fellow inmate with 'mystery weapon' in lunch queue

Daniel Wallace struck first as Robert McCann waited in the lunch queue at a ground floor café in the Forth Alpha Wing at Addiewell Prison, West Lothian. Depute fiscal Roshni Joshi said Wallace grabbed his target from behind before slashing him across the back of the neck with a mystery weapon

She told Livingston Sheriff Court that the two men then became involved in a scuffle which prison custody officers ordered them to stop. As the guards moved to intervene Wallace broke free and ran back to his cell.

He locked the door behind him and one of the prison officers followed him to check it was secure. Ms Joshni said Mr McCann suffered a large, open, horizontal cut running from left to right across the back of his neck. His shirt was also ripped.

She went on: "The complainer was escorted back to his cell where medical staff attended and cleaned the wound before sending him to St John's Hospital in Livingston for treatment. The consultant there noted a superficial incised wound of 10cm and a slightly deeper 5cm wound which required closing with six sutures."

She said the deeper wound had not pierced through the subcutaneous fat and therefore was not life threatening. Wallace, 30, pleaded guilty on indictment to assaulting Mr McCann to his severe injury in the prison by striking him on the body with an unknown implement on 15 July 2021. He admitted being on bail from Airdrie Sheriff Court at the time.

Sinead Corrigan, defending, said Wallace, who is serving an eight year sentence for attempted murder, took full responsibility for his actions and had since been moved to Shotts prison. His current sentence was not due to expire until 2027 and his earliest opportunity to apply for parole would be in 2024.

She told the court: "Mr Wallace advises that the complainer was known to him and he had been receiving threats from him saying he was going to be stabbed. "He'd heard on on 15 July that he was going to be stabbed by the gentleman that day.
